Sweden Bans Islamophobia and Promotes Hijab

Sweden has banned discrimination based on race, religion, gender, and sexual orientation, and has required a uniform costume for all public school students.

Kinga Szeredi, a native of Hungary, enrolled in the public elementary school system in Stockholm, Sweden, with her four children in 1996. She was surprised to learn that Swedish public schools only permit children to wear the hijab, a Muslim headscarf, as a symbolic reminder of who they are, and not for any educational purpose. She unsuccessfully raised the issue with school officials, who told her the Muslim headscarf was not allowed at her children’s school.

“When I asked why the headscarf was not allowed, [school officials] told me they did not see a ‘religious connection’ to the headscarf,” recalled Szeredi, who later realized that “only Islam is associated with this dress and that no other religion is being discriminated against.”

The complainant turned to the Swedish Board of Education (SBE), which ruled in her favor, stating that the school board’s uniform policy was “discriminatory.” Szeredi learned that she could apply for a religious exemption for her children by completing and submitting an “appropriate” application. The exemption would have entitled her children to wear a headscarf, but the SBE would have final say in granting the exemption.

The SBE subsequently ruled that the headscarf was not a religious symbol, and that wearing of the hijab in a public school “should have the same legal basis as wearing the uniform” and that it was, in fact, “a symbol of unity between the pupils and their school.”
